Architect or general contractor: who is liable for defects?

Both professionals are liable, but differently. The general contractor is subject to ten-year liability on the works they execute: it covers for 10 years hidden defects compromising structural integrity or making the building unfit for its purpose. The OAI architect is covered by their mandatory professional liability insurance, which covers design or supervision errors that caused damage. In case of dispute, the signed acceptance report with any noted snagging items is the reference document for any warranty claim.
